Plain-language summary. You can use CubitRace if you agree to these terms. We promise the SLA, you promise not to use the platform for the obvious bad things. Either side can leave any time; we prorate. Disputes are settled under German law.
1. The agreement
These Terms govern your use of CubitRace. By creating an account, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy.
2. Your account
You are responsible for keeping your credentials secure, the content you upload, and any actions taken under your account.
3. Plans and billing
Plans renew automatically. You can cancel any time; we prorate the unused portion. Annual plans are paid upfront and refundable within the first 30 days.
4. Service Level Agreement
99.99% uptime on Studio, Agency, and Scale (99.95% on Starter). Credits issued automatically against the next invoice. The detailed SLA, including measurement methodology, is at /legal/sla.
5. Acceptable use
See /legal/aup. The summary: no illegal content, no spam, no DoS-launching, no cryptocurrency mining at variance with your plan resources.
6. Termination
Either party can terminate the agreement at any time. We will provide a 30-day data export window on termination.
7. Liability
Our total liability under these Terms in any 12-month period is capped at the amount you paid us during that period.
8. Governing law
These Terms are governed by the laws of Germany. Disputes are subject to the exclusive jurisdiction of the courts of Berlin.
